These Terms of Use (“Terms”) govern your access to and use of the website (the “Site”) and services of Grandpa’s Hotrod Garage, LLC, doing business as HotRod Collection (“HotRod Collection,” “we,” “us,” or “our”). By accessing or using the Site or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements and that the information you provide is accurate.

2. Accounts

Some features (such as saving vehicles, tracking submissions, and managing offers) require an account. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or applicable law.

3. Use of the Site

You may use the Site for lawful, personal, non-commercial purposes. You agree not to interfere with the Site’s operation, attempt to gain unauthorized access, scrape or harvest data, upload malicious code, misrepresent your identity, or use the Site in any way that violates applicable law or these Terms.

4. Vehicle Listings, Pricing & Availability

Vehicle descriptions, specifications, photos, mileage, pricing, and availability are provided for general information and may contain errors or change without notice. Listings are invitations to inquire, not offers to sell, and nothing on the Site creates a binding contract. All vehicles are subject to prior sale. We encourage you to independently verify any information that is important to you and to inspect a vehicle before purchase. Vehicles are sold as-is except where a written agreement or applicable law provides otherwise.

5. Inquiries, Offers & Transactions

Submitting a form or making an inquiry does not create a binding agreement to buy, sell, or consign a vehicle. Any purchase, sale, consignment, financing, or transport is governed by separate written agreements between you and HotRod Collection or the applicable third party. Cash-offer estimates are preliminary, based on the information you provide, and subject to inspection, verification, and final terms.

6. Your Submissions

When you submit information, photos, or other content (for example, when selling or consigning a vehicle), you represent that you have the right to provide it and that it is accurate. You grant us a non-exclusive, royalty-free license to use that content for the purpose of evaluating, marketing, and completing the transaction and operating our business. Do not submit content that is unlawful, infringing, or that you do not have the right to share.

7. Text Messaging Consent

By providing your phone number and opting in, you consent to receive transactional and marketing text messages from us at that number, including via automated technology. 8. Financing & Transport

Financing and vehicle transport may be offered through third-party providers. We do not control and are not responsible for the products, services, terms, or decisions of those providers, and any financing is subject to credit approval and the provider’s terms.

9. Intellectual Property

The Site and its content — including text, graphics, logos, and images — are owned by Grandpa’s Hotrod Garage, LLC or its licensors and are protected by law. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

10. Copyright Complaints (DMCA)

If you believe content on the Site infringes your copyright, please send a written notice to info@hotrodcollection.com including the information required under the Digital Millennium Copyright Act (identification of the work, the material and its location, your contact information, and a good-faith statement). We will respond as required by law.

11. Disclaimers

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Any warranties relating to a specific vehicle, if any, are set out only in a signed sale agreement.

12. Limitation of Liability

To the fullest extent permitted by law, Grandpa’s Hotrod Garage, LLC and its owners, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100).

13. Indemnification

You agree to indemnify and hold Grandpa’s Hotrod Garage, LLC harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your submissions, or your violation of these Terms or applicable law.

14. Dispute Resolution & Arbitration

Please read this section carefully. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, and you and HotRod Collection waive the right to a jury trial. You and HotRod Collection agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. This section does not apply to disputes that qualify for small-claims court, and does not affect the terms of any separate signed vehicle purchase, sale, or consignment agreement, which control for those transactions.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to Section 14, any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

16. General

These Terms, together with our Privacy Policy and any signed agreements, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We may update these Terms from time to time, and your continued use of the Site after changes are posted constitutes acceptance.
